  4. This is an example of technology dictating public policy. Just as the WayFair decision is a further example of that, where the SCOTUS has allowed an expansion of states rights to the point where it potentially creates 50 mini federal governments.

    The one thing that is not being discussed with all of this is how cyberspace is redefining and or eventually going to destroy political sovereignty as we know it; and the SCOTUS’s willingness to facilitate this growing reality through WayFair shows the Court’s shortsightedness in dealing with this new and challenging reality.
