Rex Rolfing; possibly the ‘kinder gentler’ Kermit Staggers?

I have been very impressed by councilor Rolfing. While I don’t agree with him 50% of the time, I do admire him. He asks great questions and does it in a layman way, so citizens understand. You can tell he enjoys serving the citizens. That was one of the things I admired about Kermit, whether you agreed or disagreed with him, you could tell he had your best interest at heart, and I think Rex does to. Rex is a regular at the restaurant I work at, and from all accounts, he is the same kind of guy in person, this isn’t an act.

If there ever was a surprise on the new council, it is Rex. Trust me, I’m not the only one who has chattered about it, many other politicos in our community have taken notice.

Is DTSF awash in money due to special assessments? Seems so.

This is what your extra property tax money goes towards.

The organization, Downtown Sioux Falls is using special assessments to TAKE money from businesses that DO NOT benefit from the assessment. I don’t think Christmas decorations and flower baskets is a wise use of taxpayer money, especially in this economy, and if a business is not benefitting from the assessment they should be able to opt out (Item #13) If you watch the video you will see they really don’t explain where businesses are benefitting from the assessments. Councilor Kenny Anderson was the ONLY councilor who had the guts to vote NO.

A RESOLUTION  FORMTEXT APPROVING THE SPECIAL ASSESSMENT ROLL FOR THE MAIN STREET BUSINESS IMPROVEMENT DISTRICT IN THE CITY OF SIOUX FALLS, SOUTH DAKOTA.

BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:

Section 1. That the special assessment roll for the Main Street Business Improvement District in the City of Sioux Falls, South Dakota, is hereby approved and the assessment as set out in said special assessment roll approved this date is hereby levied against the property described therein and becomes a lien against such property upon filing of said special assessment roll in the City Finance Office.

Section 2. Industrial property shall be exempt from assessment. Single-family and two-family dwelling units shall also be exempt. Residential rental property whose sole use is residential and which contains more than two units, will be assessed one-half the set amount.

Section 3. Said assessment may be paid in one annual installment based on the assessed valuations of the property adjusted each year and shall be collected under Plan One—Collection by County Treasurer as provided in SDCL 9-43.

City of Sioux Falls, Project TRIM. Ignore it.

Duane, the Tree Trimming CZAR.

Watch Item #7 in the council meeting last night.

Due to three lawsuits against the city that the city lost, the city of Sioux Falls has no constitutional rights to force you to trim THEIR trees in the boulevard. The facts are simple;

• The city OWNS the trees

• The city CARRIES the liability insurance on the boulevard

• The city has NO CONSTITUTIONAL rights to force you to maintain their property

• The city has NO CONSTITUTIONAL rights to charge you for trimming

• The city has NO CONSTITUTIONAL rights to fine you for not trimming their trees

If you don’t trim the trees and the city does it (because it is their responsibility) and they send you a bill. Throw it away. Shred it. Burn it. They have no legal recourse. NONE.

Ironically, in many other cities like Kansas City and even Brookings, SD, it is ILLEGAL to trim city owned tress in the boulevard. It would be like the SFPD sending you a bill for responding to your police call or the city forcing you to mow the public parks. We pay taxes for a reason.

It is obvious that Project TRIM is a boondoggle by the tree trimming businesses in Sioux Falls. They needed the work.

End this stupidity. The city is responsible for their property, you are not.

UPDATE: I also encourage you to watch the snow removal testimony. $200 to remove 3 square feet of snow – NICE. The city acts like dictators, but they have no rights to be dictators. A word of advice; If you have to walk in the winter, wear the proper shoes. Duh.

UPDATE: Councilor Jamison offered fine amendments and it was a tie vote and the mayor had to break the tie, and he voted against the amendments, I’m sure it had to do with ‘being neighborly’ – What amazes me is that the city expects citizens to maintain their property in extreme weather conditions, but when it rains to much, they allow sewage to backup in people’s basements and blame the weather. Well guess what? This is a two-way street, if you can use the weather as an excuse, so can we.
