I guess the ruling came down late Friday. They of course are going to appeal (and have several grounds to do so). The original basis of their case was that the Planning Department (Mike Cooper) re-zoned the property internally after the vote, which ‘should be’ a no-no (realistically it needed to go back through the Planning Commission and City Council).

Hopefully we will hear more about the ruling in the coming days.

5 Thoughts on “Judge Larry Long rules against the SON neighborhood in favor of the Southside Walmart

Why would they keep fighting it? It will be open and they will still be trying to fight it, at what point do you just have to say enough is enough. It was a good fight but it’s just getting more and more pointless.

What’s disturbing is nothing about this matter was due process. It got muscled through via a few insider and political types. We needed to know there’s a fairy tale planning and zoning process. When the court decides aside from relevant ordinances and public sentiment, we’re endentured until we pay our masters for our freedom.

Yeah, sure, that whole public vote thing was not “due process” – eh Dan?

  4. Enough of shape places and mmm legacy on November 9, 2015 at 7:55 pm said:

Just like mmm. He knows who will butter his bread. All any one can do is wait for a stupid crappy firm like Walmart to go away. Most people use them for a while and then go elsewhere. I know I won’t ever use them. Too many good firms that keep money local and don’t treat people and neighbors like crap. It’s so unfortunate our shape places came canned from the Internet and our wonderful planning can no longer tell the truth. Wait til they start popping the Walmart neighborhood markets into everyone else’s front yard. Maybe then this town will wake up.

if you dont like the walmart there then move and get over it. it was zoned commercial way before houses were there if you couldnt see the signs that 85th was setup for 4 lanes and hwy 100 is next to it.
