UPDATE II: Sioux Falls City Council already knows who they will appoint to Cole’s vacant seat

UPDATE II: So I was pondering this today; does the city council even have to replace Cole for a six month period? Not at all. Yeah, the charter says blah, blah, blah, but since the council still has forum without Cole they don’t need to replace her for a short period of time. Charter does require the council to appoint someone to fill the role within a month or there will be a special election. I think the council would be wise to change it in the charter that they do NOT need to replace a councilor if there is only 6 months left on a term as long as council has quorum. Quorum is the legal precedent of attendance of voting members at a public meeting. Quorum for the council is 5 members. In other words, 5 members only can show up to a meeting and make decisions for the entire body without the absent members being present. In other words, the council could have 3 members absent for the next 6 months and still legally conduct bizzo. So why throw $10K+ at someone to be a rubber stamper? I hope the nomination is to nominate no one and conduct business as usual. But that would make sense and be less controversial. Oops.

UPDATE: So while the council had an opportunity at the informational and regular city council meeting yesterday to inform the public on how to apply, they decided to wait almost a full day and have a presser. It wasn’t much more helpful. Basically, Council Chair Merkouris said you have to basically kiss the asses of two city councilors to get nominated. Nothing about submitting an application, nothing about that application getting reviewed by council. I never again want to hear ONE single councilor BITCH about constituent participation in government when you play the Chamber Brown Nose Truffle game with this appointment. Do these folks ever look in the mirror?

I know I bring it up a lot, but the city council is very predictable. Watching the meeting tonight was like watching a community theatre play. I have been very speculative of the appointment process for replacing Cole because there has been no public announcement that people can apply to be nominated and appointed. I texted city councilor Barranco a few weeks back about how the appointment process would be handled and he told me that councilor Sigette was handling it, which I find ironic since she also was NOT elected. David also gave me no information on how to apply. I am assuming you would send your nominating petition to Jim David, Council Operations Manager; 605-367-8080. But when Mr. David talked about the item (#21) tonight he never gave an email address or a process of how to submit your nomination and none of the councilors brought it up either. I even texted councilor Barranco after the resolution vote and urged him to inform the public how to apply at the end of the meeting. Crickets. I think it is ironic that a council and mayor that whines about voter participation in elections and running for office gives the public ZERO information on how to be nominated and applying for this position. You can’t complain on one hand that no one participates in local government then turnaround and give the public ZERO information on how to get involved. Are you really that stupid and arrogant? Or more importantly, do you think the public is that stupid? I sometimes wonder what planet these folks are from . . . oh, that’s right, Planet Chamber of Commerce, where the favorite app at the mixer is brown nose truffles.

I encourage EVERYONE even if you are not interested, to apply for this nomination and appointment. Please, flood Mr. David’s voicemail box, because the council will have to answer to that the night of the appointment.

I do make a lot of predictions on this site, you know, my record is so-so, but I have to admit I was astonished that I predicted Cole’s council path almost to the tee. Magic 8-Ball, don’t fail me now!!!!!

I think they will pick Rex Rolfing or Rick Kiley, even though I think Neitzert could also be picked because he would be safe and non-controversial. I actually would look forward to Greg removing his hand from Cole’s back and just taking her seat himself. He was supposed to do a presentation at the informational today about public transit but had to cancel. That tells me he is the favorite to take the spot because he is actively getting involved. This may be a 3 man race, so to speak.

GUNS A BLAZING!

I think my favorite part of the council meeting tonight was public input. At first I was sympathetic to a gentleman that was detained by police for having a LEGAL firearm on him and explaining his situation, but then when he blamed liberals for police training, I just shook my head. I have a feeling the cops ran his plates and found some kind of violation in his past record so they decided to question him. Maybe that is NOT the case, but when you automatically blame liberals for something they have nothing to do with, you already lost you argument. He talked about some lawsuit, so we will see where this Yosemite Sam ordeal goes.

Gun people = Weird

You know, there is a lot of liberal Indy’s like myself who support 2nd Amendment rights, with some regulation, but when you have crazy talk at a public meeting, it just makes me NOT want to support you. I have crazy liberal friends that hunt like mad and have over 20 firearms, but support gun control. Build bridges not shooting ranges.

Who could serve as Sioux Falls City Councilor Cole’s fill in?

I know, those last two made me hurl a bit in my mouth. I do know that Jeff, Pat and Greg are interested and if I had to be a dictator I would pick Barth. Hopefully the appointment process is open and we see every one interested testify at a public meeting. If that is the case, I will also apply and I encourage as many as possible community activists do so also. Even if they don’t pick you, it is a learning experience in municipal civic engagement and it may convince you to run for office someday.

Who to Appoint or Not to Appoint, and other prickly stuff

Old Detroit Lewis has been down the appointment path many times. I even applied once to be appointed to the Minnehaha County Commission, and then Chair Cindy Heiberger said she was offended that I came to the public input portion of a meeting to give my resume in advance of the nomination process. Yeah, she was a real peach. She makes Councilor Erpenbach look like Mary Poppens.

Or when Dean Karsky was appointed to the City Council and when he actually ran for the seat he put on his signs ‘RE-ELECT’ Karsky. I think I asked him how can you be re-elected when you were never elected to begin with? He gave me his insurance salesman look of I either ‘I sharted or lied’. It was usually a Shlart (C).

This whole appointment process is pure hypocrisy when you consider we have to have a runoff for council races instead of a plurality.

I digress.

Recently, Councilor Dr. Cole announced she is moving for her job. Good for her, but no surprise. I warned everyone before the election that Brekke was retired and had the time to dedicate to the council position while Cole had a lot of commitments with her employer as a medical doctor and being a single mother and would not have the time to dedicate to the position. I was 100% correct. I even predicted she would not make it to the end of her term. I was 100% correct. City government is sooo predictable. Well no one listened so now here we are, we need to appoint someone to fill out Councilor Dr. Cole’s seat after she leaves town in December. The stint would be a simple 6-7 months (I know, South Park reference). Four councilors have confirmed they want to appoint someone who is not running for council in 2026 and simply want a placeholder until the next election. They also have expressed appointing a former councilor who would be willing to help out for a few months without the intention of running, which I totally support. The short list would be;

• Brekke

• Stehly

• Neitzert

Yeah, there is the vampire guy, but c’mon!?

I have suggested Brekke or Neitzert and Neitzert confirmed to me to today that he would ‘think about it’. He thought having a former councilor with no desire to run would be a good fit. Greg also had some biking initiatives he was working on when he left council that he could finish (many of the projects are already funded). But if I wanted to be a rabble rouser I would appoint Bob Kolbe. And don’t laugh, he has the experience and would run circles around the current dais.

COMPOST PILOT

I guess the City of Brookings, which oddly has a progressive community and a conservative local government has started a compost program, I have suggested to two councilors we look into this PILOT program in Sux. I guess food waste takes up 25% of the landfill and produces most of the methane gas. So it is kind of a double edged sword for us to have residents compost when we sell methane gas to POET which helps to self-fund and expand and improve the landfill. I compost as much as I can and have several bins outside. What is great is after about a year you pull from the bottom and the black fertile stuff that comes out is pure fertilizer gold.

I AM AWARE

I want to thank my diligent foot soldiers for the messages this week about a certain someone running for a certain office. I am aware and have been 🙂 all week.

NO FAUX-KING FASCISTS!That was my favorite sign I saw at the protest today;

There was a small number of protest protesters.

When I took the photo a gentleman from the group asked if I would take them down Phillips in front of the protesters with flags. This guy was incredibly respectful and likely a veteran and he did say to me that I probably didn’t want to get into the political back and forth. I said, yeah, I had a No Kings protester ask to ride down the street with a signs, and told them no. That would send the wrong message and he was totally cool. I really appreciated that. And while there was close to 2-3K NO kings protesters or more, there was about 20 MAGA supporters.

I enjoyed the peaceful interaction and commend both groups even though the SFPD and Feds tried to start a fake controversy about a stolen van with likely a joint laying on the floor into some conspiracy about Oklahoma City. What a f’kd up world we live in.

RANDOM FUNNY

As I was riding around the protest tonight a mom and her children were storming down the sidewalk in front of the wine shop just north of Minerva’s. They have this metal sandwich board sign in front of the wine shop and the boy totally smoked it. He was probably around eight? And had no mobile devices in his hand. Not only was I laughing, everyone who saw it was dying. The boy was fine and guessing by his red face, not forgetting this moment for awhile, but I have a point at his expense; They were obviously going to the protest and in a hurry, which is awesome. There were tons of families and kids and I even saw some grandparents taking a todler to the protest with her own handmade sign. A portrait of patriotism (they were likely in there 70’s or 80’s).

That is why it is so laughable and ridiculous that these supposed anti-american protesters are somehow violent?! (maybe to sandwich boards?).

No body is buying the bullshi!t. Trust me when you have 3000+ peeps on one street corner and 30 peeps from the opposition on the other street corner it sends a clear faux-king message!

It wasn’t a business decision to not allow protesters from either side to ride the Rick, it was a mortality decision, and how faux-king sad is that?! I don’t recognize this country anymore.

Why are local politicians recruiting replacements?

We saw it this past time around in the school board election where an outgoing board member recruited a replacement.

Now Sioux Falls city councilor Cole is chairing the campaign of an At-Large council candidate that wants to replace her. It doesn’t really matter who he is because he will NOT be getting my vote. I will spread the news about this unethical behavior.

• Councilor Cole is NOT running for re-election, in other words she is quitting but wants to make sure she can pick a replacement.

• This is highly unethical and not sure why local yocals are doing this lately (Poops was precedent on this).

• As a highly skilled medical doctor, Cole should know this is unethical behavior.

Guess who decides who will serve us on the council? THE VOTERS!

While it is certainly NOT unethical to advise this candidate or even volunteer for his campaign, recruiting him, endorsing him publicly and chairing his campaign isn’t right.

I hope Sux wakes up before the next election and start looking at candidates for who they are ETHICALLY instead who racks up the most donations and endorsements.

I also heard another candidate running for council MAY HAVE put down a false address. I will investigate and update (from what I found so far, he lives at the address listed on his campaign finance forms.

UPDATE: Mayor TenHaken’s PAC dumps $17,500 into Dr. Sarah Cole’s Campaign

Bought and paid for.

That was my argument all along with Cole’s candidacy. A person who hasn’t bothered to vote in a local election the entire time she has lived here (another story our incredibly inept local media never touched). It’s one thing for the mayor to endorse a candidate running against an incumbent, it’s whole other ball of wax to dump this amount of money (after the final financial disclosure before the election) towards the challenger.

You have to be one major bitter, vengeful, vindictive person to go above and beyond to eliminate an incumbent, who ironically voted for almost 99% of the mayor’s policies.

Notice how the listing of the PAC is also improper (it should be Next Generation Leadership PAC). It is also concerning that the PAC itself has yet to file their July financial report. Yesterday at 5 PM was the deadline.

You will also notice that Cole spent almost $23K on advertising and over $5k on consulting. Ironically, Rich Merkouris almost spent the exact same amount on advertising. Cole never voted in a municipal election before. She never raised her own campaign funds and it appears she had little to do with running the campaign.

UPDATE: I did find the PAC’s filings on the SOS website. The original filing was in May and an amended one in June. It is pretty clear that the entities and individuals who gave to the PAC knew exactly where the money was going;
